Jury: Rancher didn’t violate illegal immigrants’ rights

TUCSON, Ariz. — A federal jury found Tuesday that a southern Arizona rancher didn’t violate the civil rights of a group of illegal immigrants who said he detained them at gunpoint in 2004.

The eight-member civil jury also found Roger Barnett wasn’t liable on claims of battery and false imprisonment.

But the jury did find him liable on four claims of assault and four claims of infliction of emotional distress and ordered Barnett to pay $77,804 in damages — $60,000 of which were punitive.

Barnett declined to comment afterward, but one of his attorneys, David Hardy, said the plaintiffs lost on the bulk of their claims and that Barnett has a good basis for appeal on the two counts on which he lost.

“They won a fraction of the damages they were seeking,” Hardy said.

All six plaintiffs are citizens of Mexico, five of whom are living in the United States with visa applications pending, and the sixth resides in Mexico but was allowed into the U.S. for the trial, said Nina Perales, an attorney with the Mexican American Legal Defense and Educational Fund. She declined to say where in the U.S. they’re residing.

Perales called the outcome “a resounding victory that sends a message that vigilante violence against immigrants will not be tolerated.”

David Urias, attorney for the plaintiffs, said, “Obviously we are disappointed with some aspects of the verdict. But I think that overall this was a victory for the plaintiffs.”

For years, Arizona has been the busiest point along the Mexican border for illegal immigrants entering the United States.

For more than a decade, Barnett has been a controversial figure in southern Arizona. He’s known for aggressively patrolling his ranch property and along highways and roads in the area, often with his wife and brothers, on the lookout for illegal immigrants.

The plaintiffs alleged that Barnett threatened them with his dog and told them he would shoot anyone who tried to escape.

Barnett’s lawyers argued that his land was inundated with illegal immigrants who left trash on his property, damaged his water supply and harmed his cattle.

Barnett’s wife and a brother were dismissed as defendants; in addition, 10 more people initially named as plaintiffs were dropped from the proceedings.

Barnett has been known to wear a holstered 9-mm pistol on his hip and upon coming across groups of migrants, to flash a blue and gold badge resembling that of the highway patrol, with the wording “Barnett Ranch Patrol. Cochise County. State of Arizona.”

The Barnetts detain and turn over those whom they encounter to the U.S. Border Patrol. In 2006, Barnett estimated that he had detained more than 10,000 illegal immigrants in 10 years.

His actions have resulted in formal complaints from the Mexican government against what it considers vigilante actions, and in several other lawsuits, including one stemming from an October 2004 incident.

In that case, a jury awarded a family of Mexican-Americans on a hunting trip $100,000 in damages, later upheld by the Arizona Supreme Court.

Barnett’s 22,000-acre ranch, about five miles north of the Mexican border, includes private and federal lease holdings in addition to nearly 14,000 acres of state-leased land.

Don’t Get A Head of Yourself

with one comment

Oh those wacky Muslims, always taking off someone’s head aren’t they? In the most recent case of “moderate Islam” a New York television station owner killed his wife because she wanted a divorce. And in typical Muslim fashion, nonetheless, by beheading.

Muzzammil Hassan killed his wife, Aasiya on February 12th because she wanted to divorce him. She had a restraining order against him to protect her and her children from Muzzammil’s brutality.  And we all know how well those things work don’t we? In the world of Islam Muzzammil did nothing wrong, in fact it is considered an “honor killing.”  While whackjobs liberals want to separate these actions from Islam, they cannot be especially when the person doing the “honor killing” is doing so because of his religious beliefs. Trust me, if some Mormon guy killed his wife based on the teachings of Joseph Smith, the justice would be immediate and swift but somehow we are supposed to look the other way when it comes to Islam.

In a twist of irony, Muzzammil started his television station, Bridges, in order to bridge the gap of understanding between Muslims and rational people (oops I meant Westerners).  He wanted to promote the idea of the moderate Muslim. “In a 2004 press release on Bridges TV, Hassan bragged that his station would describe “Muslim tolerance, progress, diversity, service and excellence.” (Andrea Lafferty. The Traditional Values Coalition. “Religion of Peace Alert: New York Muslim TV Executives Beheads Own Wife.” February 18, 2009

Well I don’t know about you but beheading your wife, not the way to show America how moderate you are. I hate to see what he would do if he had been a fanatic! It is time we stop deluding ourselves that Islam is a religion of peace, it is not. It is a religion of hate and brutality, especially towards women. Secularists will try to say that Christians are no better when it comes to treatment of women, however men have been ordered by Christ himself to treat their wives as they would treat the church and Christ even refers to the Church lovingly as his bride. Therefore women are held in higher regard than they are in Islam.

But I digress, according to one news report Muzzammil is only being held on second degree murder charges. I am sorry you don’t accidentally behead someone, if that is not first degree murder what is? That tells you right there, Muslims because of their propensity for violence are getting away with murder, literally! After Muzzammil killed her, he went to the police station an turned himself in. And while at least that shows his conscience isn’t one hundred percent dead, it still does not make up for the act and he should still receive first degree murder charges despite his “cooperation with authorities.”

Of course, I can’t close this article without hearing from another “moderate Muslim. Khalid J. Qazi, president of the Muslim Public Affairs Council of Western New York, who knew Hassan personally said, “I cannot believe it — I know them both well,” he said Friday. “I cannot get a handle on this.”

“It would be a mistake to link an act of domestic violence to the couple’s religion, he added.

“There is no place for domestic violence in our religion — none,” Qazi said. “Islam would 100 percent condemn it.”

Orchard Park businessman charged in beheading of wife

Right Qazi, now excuse me while I laugh myself silly over that lie. Or at least I would if a 37 year old wife and mother wasn’t now dead. Too bad Qazi seems more concerned about preserving the image of Islam then he does about a dead mother.

Kicked off Team for Being Straight!

Young woman booted from team for being straight

brookeheikeCentral Michigan University is being sued after one of their women’s basketball players said she was kicked off the team due to her heterosexuality.

Brooke Heike was a high school basketball star who was aggressively sought after by several colleges that wanted the league MVP from Washington Township, Michigan, to continue her record-breaking rebounding and shot-blocking skills on their campus. After leading her team to its first conference title in 18 years as a high school senior, the 6-foot-2 forward decided to attend Central Michigan University, which offered her a full scholarship.

But Heike says she fell out of favor in 2007 with CMU’s new women’s basketball head coach, Sue Guevara, and was eventually kicked off the team. She claims the coach, who is allegedly lesbian, took issue with her heterosexuality.  Cindy Rhodes Victor of the Victor Firm, PLLC is representing Heike.

“She was not only kicked off the team, but her scholarship was taken away because the coach kept telling her that she wasn’t her ‘type,'” Victor explains. “And when Brooke would ask what was that, [Guevara] would say ‘I don’t want you to wear makeup, you have a boyfriend, I don’t want you to have a boyfriend…you’re too girly girl’ — that type of thing.”

Victor says Heike was an excellent basketball player. She adds that her teammates liked her, but still Heike’s coach refused to help her out. Heike ended up hiring independent trainers to help her. According to Heike’s attorney, cancellation of elementary education major’s scholarship came as a surprise.

“She wasn’t even told ever that her scholarship was in jeopardy or that her position was in jeopardy,” says Victor. “Out of the blue she gets a letter from the financial aid office that says your scholarship’s gone.” A teammate then told the 20-year-old that “the coach announced yesterday that you were off the team because you’re not happy.”

CMU representatives refused a request for an interview, but instead emailed OneNewsNow a statement saying they are familiar with the allegations and that they will defend their position in court. According to the case file, the coach in question was fired from a coaching job at another school in 2003. Team members at that school accused Sue Guevara of similar actions.
